Welcome to the Mangia Rewards Mobile App! These Terms of Service (“Terms”) govern your use of the Mangia Rewards Mobile App (“App”) and the services provided through the App. By accessing or using the App, you agree to be bound by these Terms.

Acceptance of Terms. You agree to these Terms by accessing or using the App. If you do not agree to these Terms, you may not access or use the App.

App Use. The App is intended for personal, non-commercial use. You may use the App to view information about Mangia Rewards, track your rewards points, and redeem rewards. You may not use the App in a manner that violates any applicable law, regulation, or these Terms.

User Accounts. You may need to create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

User Content. You may be able to upload, submit, or otherwise provide content to the App. You retain ownership of any intellectual property rights in such content. By uploading, submitting, or providing content to the App, you grant Mangia Rewards a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such content in all formats and distribution channels now known or hereafter devised (including in connection with the App and Mangia Rewards’ business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

Prohibited Conduct. You may not use the App in any way that:

• Infringes on any intellectual property rights or other rights of Mangia Rewards or any third party;
• Violates any applicable law or regulation;
• Is fraudulent, false, misleading, or deceptive;
• Harasses, threatens, or harms any person;
• Is defamatory, obscene, or offensive;
• Attempts to interfere with or disrupt the App or Mangia Rewards’ servers or networks;
• Attempts to gain unauthorized access to the App, user accounts, or computer systems or networks;
• Transmits any viruses, malware, or other harmful code;
• Collects information from or about other users without their consent;
• Violates these Terms or any other policies or guidelines posted by Mangia Rewards.

Termination. Mangia Rewards may terminate or suspend your access to the App at any time, with or without cause, without notice, and without liability to you.

Disclaimer of Warranties. THE APP IS PROVIDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND. MANGIA REWARDS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability. MANGIA REWARDS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MANGIA REWARDS’ TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED $100.

Indemnification. You agree to indemnify, defend, and hold harmless Mangia Rewards, its affiliates, officers, directors, employees, agents, and suppliers from and against any and all claims, demands, losses, expenses, damages, and liabilities, including reasonable attorneys' fees, arising out of or in connection with your use of the App, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity. You agree to cooperate fully in the defense of any such claim and Mangia Rewards reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you.
